Unfortunately this is very serious stuff that threatens the fabric of America and it is becoming common place.   Some good hearted people are making an effort to provide HONEST guardians who have every reason to do the right thing and will try to do the right thing.

The road to hell is paved with good intentions.   As Janet Phelan has been reporting some of the despicable conduct our government and our media report as occurring in other jurisdictions actually occurs in the US.    

How do we know?   We as individuals have no proof, as we as individuals have no proof that the terrible things are occurring elsewhere.    Horrors to horror - such is heresy!     How can any one of reasonable intelligence believe that the American government would kill people we do not like, gather up people who are of a minority race and intern them in 'concentration camps' and forfeit their property without due compensation!    Americans do not do such things!   Yet during WW2 we aided once of the most brutal dictators (Joseph Stalin) and closed our eyes to his genocide and we allowed the Nazis to raised money on the Streets of Chicago for the 3rd Reich.   (Western/Lawrence Ave - Chicago, Illinois)   What traitors were prosecuted?

In point of fact, we as individuals are kept in the dark by our government and in particular corrupt elements thereof.    An academic and a general during the Obama years was quite candid - they thought that we were too stupid to know what was going on and the press ******.    

A friend informed me that a senior organization was interested in provide a cadre of honest guardians for the elderly.    The organization realizes that if you place honest elements into a program's heart their will be no opportunity from the Judge, the guardian ad litems, the various attorneys etc to profit.   If the organization provides the guardians and watches them the honest guardians at the center will deter corruption.

Theoretically the thinking is sound; however, can a honest person become a pawn?   Indeed, honest people fronting for the criminals are a big asset to the enterprise.   In many of the predatory garnishments honest and honorable family members are literally sucked into the morass of criminality as they follow the advice of the experienced criminals.   These criminals survive because they are not deficient in brains and/or knowledge of human nature.    

I sent to my friend the following e-mail, to wit:

The dirty little secret that renders guardianship so onerous is the fact that ANY guardianship is an intrusion on the Rights, Privileges and Immunities of a citizen of the United States.    Government interfering in a citizen's life brings to the fore the Protections of the Bill of Rights.   These protections are not academic - but they are real and the core value of America.    As Thomas Jefferson stated: "the government that governs least, governs best!"

Intellectually good hearted people recognize this basic principle; however, they lose sight of others rights when expediency or pecuniary considerations enter the picture.    Here in Illinois our statute points out:

"(b) Guardianship shall be utilized only as is necessary to promote the well-being of the person with a disability, to protect him from neglect, exploitation, or abuse, and to encourage development of his maximum self-reliance and independence. Guardianship shall be ordered only to the extentnecessitated by the individual's actual mental, physical and adaptive limitations. 

(Source: P.A. 99-143, eff. 7-27-15."

What this means is that the control of the Court and the guardian is extremely limited and the standard to be applied is the lowest common denominator.    The fact that an elderly person acts stupidly (in your opinion - or my opinion) does not subject his rights (and in some cases his whims) to regulation.    What may seem stupid or ignorant is our collective minds may be completely logical and appropriate to the person subjected to a guardianship.    

To give you an example, 90 year old Doctor OH, a WW 2 fighter pilot after his wife died continued to drive his vehicle (all by himself) to Florida in January.      He refused to give into age and insisted on total independence.   He would account to no-one.     There was no "right" for his family to protect him from real and imagined forseeable events.    Similarly, as you are getting long in the tooth and have maintained your ability to protect yourself it would be outrageous for a guardian to be appointed for you - or me.

Where is the line to be drawn?     How is a guardian to be monitored when we have a political system fraught with corruption and fraud?     Take a look at some of the judges who occupy positions in our Courts.    Many (if not substantially all) have serious problems in their own lives and are hardly white knights!     In fact take a look at your friends - how many are without sin?     Who amongst them would you trust to make your most intimidate decisions?

The fact is highlighted by the Alice Gore and the Mary Sykes cases (09 P 4585) in which corrupt judicial officials ran roughshot over elderly people and those who loved them for PURE PROFIT.    As Morris Esformes told Mrs. Gore's family, he did it "because he could."   Thus everything that these two elderly ladies had, worked for, saved, including their dignity and humanity were taken from them by corrupt judges.   Any remedy that they might had was stolen by an 18 UsCA 371 conspiracy that including the attorney disciplinary bureaucracy.

Guardianship is a slippery slope!     Playing God with someone else's life is a dangerous endeavor!     YOU or I could wind up in this trick bag and be victimized by the cancer that allowed the humanity of two widows and  4.5 million dollars to be stolen from the Gore and Sykes estates respectively by the corrupt jurists, guardian ad litem etc. 

We just had an election, and victor was elected because so many Americans are tired of being lied to by the Establishment.   The fact is that every Establishment is going to lie to us and as WE HAVE NO EVIDENCE personally one way or another we are open to believing the lies of one side or another.   

The real challenge is for ME to not Lie to ME!    It is very easy to believe what I want to believe and therefore delude myself - And trust me - I do it all the time (and so do you).    CNN, CBS, NBC, ABC, Fox News et al would all go out of business if both you and I were totally honest with ourselves - on an objective standard.   Such of course would mean that nothing ever got done.
