Lawyer Falls For Nigerian Inheritance Scam, Gets Suspended

    Except, apparently, one lawyer in Iowa.
    Which is worse: to be unethical or to be stupid — really, really stupid?
    Who says you have to choose? That’s the lesson of today’s story about a lawyer who fell for a Nigerian inheritance scam, dragged his clients into the mess as well, and just got his law license suspended by the Iowa Supreme Court.
    Dear Friend: Please permit me to make your acquaintance in so informal a manner. This is necessitated by my urgent need to reach a dependable and trust wordy partner. We do not know each other, it does not matter.
    My tale will not cause discomfort or embarrassment in whatever form, except to a monumentally moronic lawyer — who got cleared on some (but not all) of the ethics charges against him because he genuinely believed that a trunk full of money was going to magically show up on his office doorstep….

    The lawyer in question is Robert Allan Wright Jr. The “Junior” matters here because Robert Allan Wright Sr. is one of Iowa’s most distinguished civil rights lawyers. Sadly, the apple has fallen a little far from the tree; Robert Allan Wright Jr. has had ethical issues before.
    The facts section of Justice Daryl Hecht’s opinion is something to behold. Props to Justice Hecht for displaying what our tipster described as “studied neutrality” in describing a situation like this:
    While representing Floyd Lee Madison in a criminal case in 2011, [lawyer Robert Allan Wright Jr.] was presented with documents purporting to evidence that Madison was the beneficiary of a large bequest from his long-lost cousin in Nigeria. Madison represented to Wright that upon payment of $177,660 in taxes owed on the inheritance in Nigeria, the sum of $18,800,000 would be released to Madison. He asked Wright to represent him in securing the transfer of the funds from Nigeria. In consideration for a fee equal to ten percent of the funds recovered, Wright agreed to represent Madison in the Nigerian transaction.
    Please, people, refrain from the Iowa jokes. Lawyers in Iowa aren’t the only ones who fall for Nigerian email scams; it’s more common than you might think among attorneys.
    Now, being stupid is not a crime — or even a violation of legal ethics. Robert Wright got in trouble for persuading other clients of his to loan money to Floyd Lee Madison for purposes of securing the Nigerian inheritance. For example:
    Wright was also representing Linda Putz at that time in a pending workers’ compensation case. The case was nearing completion, and Wright and Putz were awaiting receipt of proceeds of a settlement. Knowing Putz would soon net approximately $25,000 from the settlement, Wright informed her Madison hoped to borrow money to pay Nigerian authorities for an “anti-terrorism certificate” and inquired whether Putz would be willing to loan the sum of $12,500 for this purpose.
    Which she did. In fact, Linda Putz ended up loaning a total of $25,000, her entire settlement.
    Poor woman. Not only is she a Putz (hopefully that’s not her married name), but her lawyer was too:
    In the course of his work on behalf of Madison in pursuit of the Nigerian inheritance, Wright communicated with persons he believed were representatives of the “Central Bank of Nigeria,” the “African Union,” and the President of Nigeria.
    What a moron. Everyone knows Nigeria isn’t ruled by a president; it has a prince.
    Of course, this didn’t end well. Madison didn’t get that Nigerian inheritance, Wright received no legal fees from that, and the loans made to Madison by Wright’s various clients never got repaid.
    This unfortunate situation resulted in a slew of disciplinary charges against Robert Allan Wright Jr., including incompetence, failure to disclose or secure client consent to conflicts of interest, and assisting a client in dishonesty or fraud. But Wright got off on that last charge (emphasis added):
    The [Iowa Supreme Court Attorney Disciplinary] Board’s posthearing brief withdrew the allegation that Wright violated rule 32:1.2(d) by assisting a client in conduct Wright knew to be illegal or fraudulent. The Board made this withdrawal based on its view that “Wright clearly believed in the legitimacy of Madison’s inheritance . . . .” Noting “Wright appears to have honestly believed — and continues to believe — that one day a trunk full of . . . one hundred dollar bills is going to appear upon his office doorstep,” the Board asserted before the commission that Wright’s conduct might aptly be described as delusional, but not fraudulent.
    One could use much harsher words than “delusional” to describe Wright’s actions. But people in Iowa are nice, really nice (so nice that their state’s flagship law school is actually cutting tuition).
    A division of the Iowa Supreme Court’s Grievance Commission recommended the suspension of Robert Wright’s license to practice law. Once again displaying impeccable judgment, Wright appealed that recommendation, so he could get sanctioned and embarrassed on a grander scale by the Supreme Court of Iowa itself:
    We suspend Wright’s license to practice law in this state with no possibility of reinstatement for a period of no less than twelve months. This suspension applies to all facets of the practice of law, including but not limited to advertising his services.
    And as we all know from those ubiquitous disclaimers, lawyer advertising can include sending emails.

    Is there anything quite as grand as allegations of a UVA Law grad behaving badly?



    Today’s installment of “Lol-VA” involves serious allegations against a lawyer and 2009 graduate of UVA Law who was dubbed a “rising star” in Democratic politics in Virginia. Unfortunately, instead of the usual fun allegations of getting belligerent and drunk or stealing transcript paper, these claims are more serious.



    Albemarle County supervisor Christopher Dumler was arrested and charged with forced sodomy, yesterday.



    Collars should go down to half mast, as these allegations could put a stop to Dumler’s career…





    WVIR has the report on Dumler’s arrest:



    Court records indicate Dumler is accused of having anal intercourse with a victim through force, threat or intimidation. Albemarle County police say this is an active case, and that the investigation is ongoing.



    The arrest made was following an October 16 investigation into an incident on October 4. Police are not saying where the incident took place. The victim’s name is not being released but police say she was known by Dumler.



    Albemarle County Police Chief Steve Sellers said, “The victim in this case was known to Mr. Dumler. The Albemarle County Police Department has been working closely with the commonwealth attorney’s office throughout this investigation.”

    Dumler was already a respected elected official, despite having graduated from UVA Law just three years ago. From The Daily Progress:



    An unmarried lawyer who is something of a fixture in the Charlottesville-area social and political scene, Dumler, 27, has served in elected office for just 10 months but was regarded as an emerging force in the local Democratic Party. He won the county’s Scottsville District seat last November.

    Whether or not these allegations are true, they’re going to sodomize Dumler’s Google footprint.

    ‘Sh*t Law’ Attorney Sentenced to Perform Community Service at Sewage Treatment Plant

    This community service stinks.

    Ahh, “sh*t law.” In case you aren’t familiar with the term, it’s what some lawyers rudely and condescendingly call legal practice outside of Biglaw. From traffic tickets to personal injury, you name it, and it’s apparently a derivative of “sh*t law.”



    Back in March, we brought you a story about Joseph Neal Jr., the apparent king of one of these so-called “sh*t law” practices in Augusta, Georgia. Neal, a prominent personal injury attorney, earned our Lawyer of the Day title after he and his ex-wife racked up criminal charges for allegedly drugging and sexually assaulting the family babysitter. Neal later went on to earn 21% of the vote in our March Lawyer of the Month competition.



    Now, just a few short months later, Neal has been sentenced after accepting the terms of a plea bargain. The deal reduced a felony rape charge to two misdemeanors. Neal will serve three years of supervised probation, and he’ll also commit to a term of community service that some would call a bit of poetic justice….





    Last week, Superior Court Judge James Blanchard sentenced Neal to 100 hours of community service to take place at a sewage treatment plant. From “sh*t law” to literally wading in sh*t; how do ya like them apples? Judge Blanchard claims that he chose the sewage plant for Neal “in keeping with the conduct in this case.”



    And as for Neal’s improper conduct, the Augusta Chronicle describes some text messages sent between Neal and the babysitter that caused prosecutors to admit this had turned into a “he said and she said” case:



    In one exchange, read aloud by the baby sitter, Neal described himself as a “sex god” and the woman countered, “I’ll have to be the judge of that.”



    “I dare you to be the judge of that,” Neal replied.



    The messages continued in that manner until the woman said she “doesn’t want to be a tease.”



    “You can be our babysitter and sex slave LOL,” Neal stated.



    “I don’t know about that,” the woman replied, then later, “You’re going to have to contain yourself.”

    Alas, thanks to his conduct, this “sex god” will have to further sully his hands with sh*t outside the confines of his personal injury practice.

    Depending on which state you’re licensed in, you may have to do a certain number of pro bono service hours in order to keep up with your ethical obligations. In general, doing pro bono work is a great way to get that happy feeling deep down inside.

    But one lawyer in Georgia may have a different idea about how to achieve that sense of inner nirvana. He’s allegedly more interested in getting serviced pro boner than offering pro bono services.

    That being said, let’s meet our Lawyer of the Day, a man who stands accused of trading contraband for peep shows from prisoners at the local jail….

    Michael Stuart Winner, a graduate of Mercer Law School, is no stranger to disciplinary action by the state bar, but apparently he just can’t get enough of it. This time around, he’s been accused of offering female inmates prohibited items and legal services in exchange for sexual favors. The Marietta Daily Journal has more:

    Winner provided female inmates at the jail with prescription drugs and legal help in exchange for the women lifting up their tops to expose their breasts, which Winner would watch from the other side of a glass partition, [Cobb County Sheriff Neil] Warren said. He said the inmates also promised Winner sex when they were released from jail.

    Warren said the number of inmates that Winner made these exchanges with was still under investigation. While he said it was more than one, it was not widespread.

    Winning! And you thought “Put ‘Em on the Glass” was just a Sir Mix-A-Lot song. Winner also allegedly exposed himself to a female inmate, according to the Atlanta Journal-Constitution. What’s it say about you when the only play you’re getting is through a glass partition?

    Winner has been charged with the following felonies: four counts of conspiracy to commit crime, three counts of unlawful trading with inmates, one count of a violation of the Georgia Controlled Substances Act, and one count of “use of communications facilities to violate provisions prohibited.”

    Congratulations, ladies, because it looks like you picked a real Winner to represent you.
