Elder guardianship aims to bilk more than help


I wrote about the plight of 94-year-old Betty Winstanley, who resides at the Masonic Village retirement home in Elizabethtown, Pa. She doesn’t want to live there anymore. Now that her husband of 72 years is gone, she longs to move to a care home closer to her two children in Maryland. The state of Pennsylvania won’t let her leave.
To the state, Betty is case #1201 of 2014, just another old person the court has declared, “totally incapacitated.” Once someone is so labeled, they get a court-appointed guardian who, literally, takes over their life.
Guardians decide all the ward’s finances, who can visit and for how long, when or if they can leave the home – everything.
This is widow Winstanley’s lot in life now. Yet when you talk to Betty, she is charming, articulate, highly intelligent and simply looking for a less lonely life during her last years.
I had no idea the enormity of the nation’s elder guardianship problem or how many individuals and organizations are fighting to change the now bastardized set of laws that can turn an elder’s life into a nightmare.
If the aging Baby Boomer generation hasn’t already experienced the problem with their own parents – steel yourselves – you could be the next one to get caught up in this awful system.
Reader Marcia Southwick wrote to tell me about Boomers Against Elder Abuse, a New Mexico organization fighting against abusive court-ordered guardianships.
“There is plenty of it going on in New Mexico but records are sealed here, and families gag ordered and made to sign no-sue agreements once the guardianship/conservatorship is over,” she wrote. Her group’s Facebook page lists nearly 350 elder guardianship horror stories from just about every state in the union.
From Austin, Kelley Smoot Garrett also wrote about New Mexico’s system and the arrogance displayed by the court.
“In NM’s 2nd Judicial District Court,” she said, “The judges … ALWAYS favor their court-appointees and never listen to the families or the elderly because they are too busy allowing the ‘incapacitated’ person’s property to be sold off – frequently without the appropriate court-order in place – for pennies on the dollar.”
There is no way for me to confirm judicial misconduct in sealed cases, but the sheer volume of complaints is staggering. They highlight citizen’s attitudes about the way the legal system has taken laws designed to help the elderly and twisted them to insure continued employment for judges, lawyers, court-appointed guardians, social workers and those who own or staff elder care homes.
And it is, conveniently, paid for out of the estates of the elderly.
“My mother has been shanghaied into a nursing home, drugged, assets disbursed,” a woman named Frania wrote from Baltimore, Md. “The guardian of (Mom’s) property is like God. And the judge is cocky, completely confident, arrogant (and) does exactly what she wants knowing nothing will happen to her.”
It doesn’t matter if the elderly person has a will or living trust; it can be automatically overridden by the state. Once someone approaches the court for assistance with an elderly person – say, a warring sibling or nosy neighbor – they are in the clutches of this dysfunctional system.
Andy Skupaka wrote to say he has experienced it.
“For profit guardian/ conservatorship is now a big business with massive power. The elderly are being denied their civil rights and due process,” he said.
“Their estates and legacies are being looted. … Family members are slandered, libeled, vilified and driven into bankruptcy while trying to save their loved ones from this exploitation.”
Some report that they were tricked by unscrupulous lawyers.
Darryl Steiner, a decorated and now retired Army major wrote from Clearwater, Fla. He said he went to his lawyer for financial advice and suddenly found himself in what’s called a “plenary guardianship.” Now he has no control over his money for his son’s education.
“I do have a good monthly retirement income that disappears as soon as it comes in,” he said. “I am desperately seeking help.”
Several groups, nationwide, are working to change this awful system.
Among them, the National Association to Stop Guardian Abuse, and the Catherine Falk Organization. Catherine, daughter of the late actor, Peter Falk, of “Columbo” fame was denied visitation by her stepmother during her father’s last days. Now her group lobbies for a passage of a bill to remove barriers to family participation, while still providing ample protection for those in true need.
Catherine Falk says lawmakers in nearly two dozen states have responded positively to the need to change the status quo.
Change couldn’t come fast enough for Betty Winstanley.
Ever since her eldest son, Richard, took a family squabble to court in July 2014, she has had to live where her husband died – and without the family she so desperately craves.
Her estate was worth $1.9 million before her guardianship began in July 2014. Wonder what it’s down to now?

Niagara Falls| Divers from the U.S coast guard took part this morning, ina delicate wreck recovery operation to bring to the surface a Nazisubmarine discovered two weeks ago  at the bottom of Lake Ontario.

The U-boat was spotted for the first time by amateur scuba divers in late January and they had contacted the authorities. Archaeologists associated with Niagara University of  and master divers from the U.S Coast Guard were mobilized on site to determine what it was, and they soon realized that they were dealing with a German submarine that sank during World War II.
A wreck recovery vessel  of the Great Lakes Shipwreck Historical Society was mandated to refloat the ship and bring it back to Niagara Falls, where it must be restored before becoming a museum ship. The delicate recovery operation took nearly 30 hours to complete, but the submarine was finally brought down on the bank with relative ease.

The divers of the U.S. Coast guard braved the frigid water temperature to go attach cables to the wreck for the recovery operation.
The submarine was identified as the UX-791, a unique experimental German submarine, based on the U-1200 model, and known to have participated in the “Battle of the St. Lawrence”. It  was reported missing in 1943 and was believed to have been sunk near the Canadian coast.
Professor Mark Carpenter, who leads the team of archaeologists, believes that the U-boat could have traveled up the St-Lawrence River, all the way to the Great Lakes, where it intended to disturb the American economy.
A report from the dated from February 1943 suggests, that the ship could have attacked and destroyed three cargo ships and two fishing vessels, even damaging the USS Sable (IX-81), an aircraft carrier of the U.S. navy that was used for training in the Great Lakes, before finally being sunk by anti-sub grenades launched by a Canadian frigate.
“We have known for a long time that the Nazis had sent some of their U-boats in the St-Lawrence River, but this is the first proof that they actually reached the Great Lakes,” Professor Carpenter told reporters. “This could explain the mysterious ship disappearances that took place in the region in 1943, and the reported “Battle of Niagara Falls” which had always been dismissed as a collective hallucination caused by fear.”
The restoration of the submarine could take more than two years, but oncecompleted, the museum ship is expected to become one of the major touristattractions of the region.

BOSTON (AP) — The 1st U.S. Circuit Court of Appeals will not reconsider a Rhode Island estate planner's bid to withdraw guilty pleas to charges that he ran a $46 million investment scheme targeting the terminally ill.
The Providence Journal reports (http://bit.ly/1nkqg89 ) the federal appeals court in Boston declined Tuesday to re-hear arguments from Joseph Caramadre. The Cranston resident had been seeking to be allowed to withdraw his guilty pleas to conspiracy and fraud charges.
Caramadre and an employee were convicted in February 2014 of using the personal information of dying people to purchase life insurance investments that paid out when they passed. Caramadre paid the sick victims a few thousand dollars for their signatures on documents.
The court's decision upholds a three-judge appeals panel's ruling last month to let the pleas stand.

KEOKUK, Iowa -- An Iowa woman was arrested Friday and charged with financial exploitation of the elderly after an investigation by Quincy police.
According to a Quincy Police Department news release, Laura Hawkins, 55, of Keokuk, was arrested in Keokuk. Police said they were notified by Sycamore Healthcare of a 77-year-old resident who was possibly being financially exploited by a family member who was acting as a power of attorney for the person. An investigation found that several thousand dollars allegedly had been misused. Hawkins was released on a notice to appear. Her first appearance in Adams County Circuit Court has not been scheduled.
The Keokuk Police Department assisted with the investigation.

The long hours and grueling pace of the presidential campaign may be finally catching up with a rapidly aging Bill Clinton.
During an appearance in Bluffton, South Carolina on Friday, a former Marine interrupted Clinton’s speech and asked him to address what Hillary was going to do about the VA.

“What do you think should be done with the VA?” Clinton said in a raspy voice, turning the question back on him and yielding the floor.
“The thing is, we had four lives in Benghazi killed and your wife tried to cover it up,” the Marine responded, eliciting boos and jeers from the crowd.
As the man continued to talk, audience members yelled at him to sit down. “Are you going to let me answer?” Clinton asked. “This is America. I get to answer,” he said. “You listen to me. I heard you,” Clinton snapped as the man turned around and began addressing the crowd.
“I heard your speech. They heard your speech. You listen to me now,” Clinton said, his voice cracking.
“Am I allowed to answer? I’m not your commander in chief anymore but if I were, I’d tell you to be more polite and sit down.”
“I wouldn’t listen!” the man shouted in return.
“Do you have the courage to listen to my answer? Don’t throw him out. Shut up and listen to my answer. I’ll answer it,” Clinton said as the man was pushed out of the gymnasium by sheriff’s deputies.
“Can I just saying something? That’s what’s wrong: his mind has been poisoned by lies and he won’t listen,” Clinton said.
A woman just jumped up and began shouting at the former president.
“Hillary lied over four coffins,” she said as a man near her yelled “Bullshit.”
“She lied and she lied to those families. So all those families are liars?” she said as Clinton tried to stop her and a Secret Service agent moved closer to the former president.
“Did she lie?” the woman said as Clinton responded, “Will you let me answer?”
“No,” he said. “Why are you afraid to listen to my answer?” Clinton said.
“Are you afraid?” he asked her. “No I’m not afraid because I know you’re going to lie,” she responded.
The video shows her then forcibly removed from the room. Clinton never did answer.

Heirs accuse Bethalto woman of wrongful property transfer
EDWARDSVILLE – Three heirs of an estate as well as the estate administrator are suing a Belthalto woman, alleging a questionable real estate transaction.

Michelle Chapman, Monica Winstead, Sheila R. Bowen and William Ressler Jr., as administrator of the estate of Frederick Reynolds, filed the lawsuit Feb. 18 in Madison County Circuit Court against Lisa Bricker of Bethalto, alleging unjust enrichment and negligence, plus several other counts.

The plaintiffs are the legal heirs of Peggy Reynolds and all reside in Madison County.

On Feb. 19, 2014, the complaint states, the defendant recorded in Madison County a quitclaim deed that transferred title to a property from the defendant and Peggy Reynolds, tenants in common, to Lisa Bricker. However, Peggy Reynolds died before February 2014, the suit says.

For the count of negligence, the plaintiffs seek $50,000 from Bricker, whom the suit says caused them irreparable harm and injury.

The suit further alleges Bricker has not provided any accounting for any funds she has received from the property, nor has she distributed that money to the plaintiffs. For that, the plaintiffs seek another $50,000.

In addition, the lawsuit alleges Bricker made fraudulent misrepresentations and otherwise acted wrongfully by transferring title of the property to herself without the consent of the plaintiffs.

Chapman, Winstead, Bowen and Ressler seek exemplary and punitive damages of $2 million, restitution of all amounts, restoration of Peggy Reynolds' interest in the property, plus court costs, attorney fees and other relief the judge deems just and proper. They are represented by attorney Bill T. Walker of Granite City.
