WHITE PLAINS, N.Y. (CBSNewYork/AP) - A Florida woman who was sentenced to life in prison in the killing of her millionaire husband claims she’s still entitled to half their marital property, including his Batmobile.
Narcy Novack of Fort Lauderdale is challenging a federal judge’s finding that she forfeited any claim to her husband’s assets because of her conviction.
In court papers, she demands a hearing on her claim to half the marital property. She says that includes a 1977 Lincoln modified to resemble the Batmobile.
“Since I own joint title to the above property and/or such property was acquired during the course of my marriage to Ben H. Novack Jr., I assert my one-half interest in such property,” wrote Narcy Novack, in court papers filed Wednesday in U.S. District Court in White Plains.
In the court filing, Narcy Novack also asks for a hearing to reverse the order blocking her from acquiring half of his estate, saying their Florida home and other assets “acquired during my marriage to Ben H. Novack Jr. on or about February 1, 1994, and jointly titled.”
Narcy Novack, 56, and her brother Cristobal Veliz, 59, were convicted last year of hiring hit men for the 2009 beating deaths of Ben Novack Jr. in New York and his mother, Bernice Novack, in Florida.
Ben Novack was bound, beaten and had his eyes gouged out when he was found at the Hilton Rye Town hotel on July 12, 2009.
Three months prior, his mother was struck and killed by a monkey wrench, authorities said.
Under Florida’s ‘slayer statute’ law, individuals are banned from benefiting from their crimes.
Ben Novack’s father built the Fontainebleau hotel in Miami Beach.
The U.S. attorney’s office declined comment
