The Fascowitz (sp) case out of Florida is a real study in corruption ala Chicago style,    

 

As I recall, this is the case in which a Chicago Attorney having some clout, filed an Estate in Florida for a deceased resident of a nursing home.   This facility was controlled by a well-known Chicago predator, who is in some manner related to the Chicago attorney.  The Attorney in her petition to the Florida Court claimed to be a very close relative of the deceased and therefore entitled to inherit the entire estate of the deceased.  

 

The Florida attorney General in a rare exercise of doing his job was so appalled by the audacity of a stranger to file such a blatantly false claim that he filed objections to the claim actually specifying that the claim was false.

 

Florida politics being what they are the 2 million dollar estate (there have been statements that the estate only had a value of a million dollars) claim was compromised and a settlement was arrived at wherein the Chicago attorney and selected members of her family received 1/2 of the estate of about a million dollars.   A member of her family who was reputed to not be right in his head (and killed another human being) is reported to have been eliminated from the fictitious family tree.

 

I also recall that this esteemed Chicago Attorney also was reported to have been the leader of a gold mining operation that took place in the mouth of a disabled person by the name of Alice Gore.   The expedition removed 29 teeth and harvested some gold - this gold was never inventoried.   It is assumed that the hue and cry from the family of the disabled person thwarted a "gold rush" in other guardianship estates.   I will have to ask Ms. Phelan to come to Chicago and ferret out if there is a clandestine gold mining expedition going on either on the 18th Floor of the Daley Center or at the Attorney Disciplinary offices administered to by Mr. Larkin.    

 

Anyhow, when people within the Chicago Orthodox Jewish Community learned of the outright fraud committed by this Chicago Attorney, they raised a hue and cry.  Local Chicago authorities thus have a smorgasbord of elder abuse/elder exploitation/elder isolation cases that had to come to life.   Thus we assume that they were/are very busy doing whatever it is they do to protect the elderly and the disabled and therefore disinterested.  Otherwise occupied.

 

The Attorney Registration and Disciplinary Commission was impressed with the ingenuity of the Chicago Attorney and the off the record and tax free considerations that the nursing home elite could provide that they joined in the "cover up!" of the F Estate.   They (Illinois Attorney Registration and Disciplinary Commission = and the Supreme Court of Illinois) are reported to have given their approval to such conduct and strongly condemned the reporting of such criminal conduct by the public and attorneys as contrary to the Best traditions of the Illinois Bar!  Mr. Larkin and his co-conspirators felt that the ingenuity of this Chicago Lawyer in bilking a decedent's estate of over a million dollars was a great accomplishment worthy of reward!    Ms. Denison in reporting this violation of law by a Chicago Attorney was meted out a three year suspension of her law license.   

 

This morning I happened to stumble upon the blog "probate sharks" and noted the following comment:

 

" I see. But I know ******, and I see an entirely different side of her. I see her as a woman that has undergone the most horrible experiences, who then went to law school and chose her field of work in the hope that she could ameliorate the suffering of others. I find it hard to believe that she has intentionally caused any innocent person to suffer. She certainly has not enriched herself, as others in her field have.

There are going to be cases where good people have totally opposed ideas of what the best course of action is, and the unfortunate result is that each side thinks the other is wicked and cruel.

I used to practice law. Once, when I went to court, some officers of the court thought I was someone that had given Ms.**** a lot of grief, and it looked like they wanted to take me out and beat me up. In other words, she was very well liked and highly respected in that courtroom.

I'm sorry you experienced the hardship that has resulted in such consuming hatred. "

 

   I thoroughly enjoyed Mr. Larkin's co-conspirator's comment.  The equation of seeking an HONEST investigation with "consuming hatred" is an amazing leap even for a Chicago attorney with a flair for fiction.   

 

Assuming that it is consistent with the best traditions of the Illinois Bar for Chicago Attorneys to make false claims of heirship in foreign courts (such as Florida, California) is it in the best traditions of legal profession not to report or pay taxes on the booty from such excursions?   

 

In answering the question you have to remember that I received my meager education at the University of Chicago earned my law degree at a small Catholic college by the lake.  Thus, I am at a disadvantage = the Jesuits feed me all that anti political correctness about the Ten Commandments, the Rule of Law, ****.  Worse yet, I lost my way and believed all of that stuff!  

 

The Jesuits and the tax code made be believe that indeed there are both State and Federal taxes due.   As the Chicago Lawyer was not an heir to the F Estate, the dollars allocated to her by the settlement were ordinary income and thus taxed by both the Federal and the State (Illinois) as earned income.   (Of course Larkin and his co=conspirators whose overt acts are the 'cover up' of this criminal activity by the Chicago Lawyer have joint and several liability).  Not paying Federal and State Income taxes is a felony and even Mr. Larkin and the Chicago lawyer should be first made to pay the taxes due, plus interest, and plus penalties and then disbarred.

 

In Illinois it is apparently in the best traditions of the bar to exploit, abuse, and isolate the disabled and elderly, but, not paying your taxes is still BAD, BAD, & BAD.    Mr. Larkin and Ms. ***** you all can run but you cannot hide.   

 

 Rest assured if you even at this late date filed the appropriate 1040 tax returned the schoolmaster and I will not "beat you up" as the court personnel in your comment wanted to do, but we will openly and notoriously fight and lay down our lives to make certain that your civil and human rights are fully protected.

Mr. Larkin and Ms. ****  when you write comments on the various blogs you should be proud enough of your writing that you can sign your name.
