Shafer and Patience Bristol sue blind man for libel, now ask taxpayers to pay the bill "You're a blind bastard who should never have married a sighted wife!" ...        Shafer                         Bristol                     DA Steve Wolfson      Marcy Dudeck, Charles Pascal INSIDE VEGAS by Steve Miller AmericanMafia.com June 30, 2014 LAS VEGAS - On April 10, 2014, private "guardians" Jared Shafer, his former employee Patience Bristol, Shafer's business Professional Fiduciary Services of Nevada (PFSN Inc.), PFSN office manager Amy Deittrick, Deittrick's  AVID BUSINESS SERVICES, their attorneys Mark Solomon, Dana Dwiggins, Alan Freer, and Robert Simpson, and CPAs Bruce Gamett and Shawn King filed a civil libel lawsuit against Charles Pascal who has been blind since birth. Plaintiff Patience Bristol is now serving 3 - 8 years in Nevada State Prison for ripping off Shafer's elderly wards.   Plaintiffs Gamett, King and Shafer in 2009 were Defendants accused by the U.S. Securities and Exchange Commission of participating in a "Ponzi Scheme" that "fraudulently offered and sold approximately $180 million in unregistered notes to more than 800 investors, many of whom were senior citizens." After being named as Defendants, Shafer, Gamet, and King agreed to return a portion of their commissions in order to escape prosecution. Shafer, PFSN Inc., Bristol, Deittrick, and AVID BUSINESS SERVICES, are defendants in another civil lawsuit filed on  May 1, 2014 by one of PFSN's former wards who claims she was robbed of over $450,000.00 while she was under PFSN's control. Despite Shafer, Bristol, Gamett, and King's own brushes with the law, they proclaim that their professional reputations have been damaged by Pascal and others who allegedly wrote derogatory Internet articles about them and their involvement in court appointed Nevada guardianships. (INSIDE VEGAS is aware of the names of four individuals, not including Pascal, who admit to authoring critical RipOff Reports about Jared Shafer, Patience Bristol, and Clark County Guardianship Commissioner Jon Norheim. The identity of these individuals is protected under the Nevada Reporter's Shield Law.) Plaintiffs Blind-Sided By Blind Man Charles Pascal lives in Southern California and is indigent. He cannot afford an attorney and is acting pro se in this litigation. He also has a Masters Degree from Loyola Marymount University, a tremendous feat for a sightless person. On May 12, 2014, Pascal asked the Clark County District Court to require Shafer, Bristol, and the other plaintiffs to accommodate his disability by providing all legal filings in Braille and audio per the Americans with Disabilities Act (ADA).  Shafer and the other plaintiffs refused to comply, then last week reportedly tried to get the local District Attorney to criminally prosecute Pascal for the alleged misdemeanor crime of libel in order to try to save paying the Braille and audio court costs. If the DA complies, the Braille and audio transcriptions his office pays to generate would become public record and could be used for free by Shafer, et. al., in their civil case against Pascal saving them an estimated $100,000.00 or more in court costs. Unable to read or respond to his complaint, Pascal asked a friend who helps persons with visual disabilities to write a dictated letter to Clark County District Judge Joanna Kishner explaining his situation, and the plaintiff's refusal to abide by the ADA law. He also dictated letters to the ADA,  National Federation of the Blind, U.S. Department of Justice (DOJ), and the American Civil Liberties Union (ACLU) asking for assistance. The ACLU intervened on Pascal's behalf.  Judge Kishner, on June 12, 2014, issued an order requiring Shafer to transcribe his initial 1,600 page complaint into Braille and audio along with all future filings. It cost $5.00 per page to translate a document into Braille, hence Shafer's reaction to try get the taxpayers to foot the bill. The transcription cost does not include paying someone to read the documents into a recorder,  binding, packing or shipping. It appears that unless the plaintiffs can get the taxpayers to foot the bill to comply with ADA requirements, they have been blind-sided by a legal requirement they should surely have known about before they filed their lawsuit. Shafer accused Pascal of writing over one hundred RipOff Reports that contain allegedly libelous statements about him and his crew. Pascal claims to know nothing about the origin of the RipOff Reports. He also told INSIDE VEGAS that Shafer cost his mother-in-law Marcy Dudeck over $500,000.00 in excessive billings and legal fees drained from her trust account, though Shafer hadn't performed any guardian services for Mrs. Dudeck before her death. Mrs. Dudeck's family say they were never informed of the cashed checks after her death, and she was under guardianship at the time she purportedly signed the checks, therefore she was legally prohibited from being a signatory on any legal document. Marcy had been declared legally incompetent by the Nevada court in September 2006, over a year before her checks began being signed with her signature and cashed by Shafer. Dudeck's daughter, Heidi, claims her mother's signature was forged, something District Attorney Wolfson should rightfully be looking into - instead of reportedly considering the criminal prosecution of Mrs. Dudeck's blind son-in-law for allegedly committing the misdemeanor crime of libeling Shafer, et. al.     Marcy Dudeck died on February 25, 2010 while under Jared E. Shafer's "guardianship."  Her trust account had been completely depleted.  According to the coroner, her cause of death was "dehydration." According to Pascal, his wife Heidi’s past was taken when PFSN Inc. took over her mother's life and property.  "Heidi’s needlepoint works she made as a child, senior prom pictures and wedding photos were destroyed by Shafer and Bristol along with so many other items of sentimental value.  She never got the opportunity to say 'I would like to have that.'  I'm burning inside as I say this because this is the worst kind of robbery.  Theft of a life's memories.  That is what Heidi wants the world to know Shafer and Patience took from her." In the meantime, Jared Shafer has not responded to repeated requests to tell his side of this story. In an alleged effort to save the thousands of dollars it would take to translate the libel complaint into Braille and audio, according to court sources, Shafer has also threatened to sue the Clark County District Court for "violating his civil rights" by requiring him to comply with Pascal's demands. Shafer reportedly said he was the oldest person still practicing in family court and his word carried weight. He went on to tell court officials that he should be listened to. Pascal contends that Shafer was aware of his disability for over seven years, therefore he should have realized Pascal could not read or respond to the lengthy complaint filed against him. Had Pascal not responded to Shafer's complaint in a timely manner, a summary judgment could have been rendered against him, as may have been Shafer's plan all along.  Shafer actually knew as far back as May of 2007 that Pascal was visually impaired when Pascal attended one of his mother-in-law's Family Court hearings. In Pascal's letter to Judge Kishner, he backs up his contention that Shafer had prior knowledge of his blindness by stating: "Defendant alleges on November 3, 2009, in the courtyard of the Las Vegas Family Court, Mr. Shafer referred to Defendant as a blind b***ard who should have never married a sighted wife." According to a source in the Clark County District Attorney's office, Shafer wants the DA to expend tax dollars to prosecute Pascal under NRS 200.510. NRS 200.510 Definition; penalties; truth may be given in evidence; jury to determine law and fact.       1. A libel is a malicious defamation, expressed by printing, writing, signs, pictures or the like, tending to blacken the memory of the dead, or to impeach the honesty, integrity, virtue, or reputation, or to publish the natural defects of a living person or persons, or community of persons, or association of persons, and thereby to expose them to public hatred, contempt or ridicule.       2. Every person, whether the writer or publisher, convicted of the offense is guilty of a gross misdemeanor. If Wolfson agrees to perform such an obvious favor, the courts would have to pay for the Braille and audio translations that could then be used in Shafer's civil lawsuit against Pascal. But Wolfson would also have the extra burden of prosecuting over state lines, and be forced to provide Pascal a public defender at taxpayer's expense. This, when hundreds of felony requests for prosecution by the LVMPD are passed over by the DA's office each year because of budgetary constraints. The same source in the DA's office told INSIDE VEGAS that Steve Wolfson has too much integrity to grant such a favor for anyone! "The DA’s resources are stretched so thin that many misdemeanors, especially those that don't involve physical harm, aren't acted upon by his office. That's why so many prostitutes, pimps, and drug addicts are let back onto the LV streets within hours of their arrests. This complaint is a misdemeanor and Pascal could not be forced to go to  Nevada, nor could they enforce a warrant to be transferred out of state because it's a not a felony." At this juncture, Jared Shafer, convicted felon Patience Bristol, and their band of co-plaintiffs have been unable to prove the identity of any person or persons responsible for authoring the allegedly libelous RipOff Reports about them. However, their alleged efforts to burden the taxpayer's with their legal expenses may have backfired. According to court house sources, Shafer's refusal to comply with Judge Kishner’s order to accommodate Pascal, and the revelation that the county previously received $50,000.00 from the federal government to purchase a Braille embossing machine that was never purchased, has caused the DOJ to open an ADA audit of Clark County. Based on the projected work hours needed to comply with an ADA audit, the Pascal libel suit has probably drawn much more courthouse attention than the plaintiffs ever intended. And few would be surprised if this obvious SLAPP suit is reluctantly dismissed by the plaintiffs who do not want to pay for the Braille or recordings in the event the taxpayers are not burdened with the cost. In the meantime, Shafer continues to conduct his business unencumbered, and his victims are still free to publicly express their contempt.
