Kendall County probate lawyers oppose judicial proposal

BOERNE — Local lawyers Monday decried a proposal to ask lawmakers to convert the Kendall County court-at-law into a state district court, calling it a step backward and emphasizing its negative impact on probate cases.
The Kendall County Bar Association last month recommended elevating the county court-at-law to a district court just for Kendall County. Currently, it is one of four counties in the 216th judicial district.
Attorney Frank Hill Jr. on Monday presented Kendall County Commissioners with the view of five dissenting bar members. Without a county court-at-law, probate matters would revert to the county judge, but they are too complicated for that, he said.
“This is a serious matter,” Hill said.
The proposed change came in response to neighboring counties seeking a larger realignment under which the 216th and 198th judicial districts would each cover Kerr County and either Bandera and Gillespie Counties (each taking one). A proposed new 440th district would include Kimble, Edwards, Mason, Menard and McCulloch counties, which now are in the 198th, along with Kerr County.
