OBRA SPECIAL NEEDS POOLED TRUSTS and OTHER "MEDICAID PLANNING" TRUSTS: LESSONS FROM A COOK COUNTY PROBATE ATTORNEY
We have had many requests to refer the new website address for the informational video that we referred to in our article titled: "OBRA Trusts: Medicaid Planning or Medicaid Fraud and Abuse." Some find this video controversial, as the attorney advises her peers on which Trusts are lacking oversight, and are thus easier to place estate funds into in order to qualify a ward for Medicaid; she also advises her peers to be careful with their verbage so their attorneys fees may be paid from the disabled person's trusts after the estate is tucked away into the trust and the ward is placed on Medicaid.
