We are losing our democracy

This elder cleansing battle has been a blunt education.   I had not been aware that I was living a sheltered life surrounded by wonderful and nice people.   I thought that the practice of Law (all 50 plus years of it) was the battleground of democracy and proof that it worked.

Yes, I saw some of the seamier side of life, but, I also saw Americana and its hardworking and honest people.   The miscreants were (or appeared to be) a distinct minority whose ugliness was drowned out by all the unforgettable people I rubbed shoulders with on a daily basis.   Even in this struggle the cream rises to the top.   Tim Lahrman is an example.   Tim with problems of his own literally will drop everything to assist a victim (or the victim's family) of elder cleansing.   JoAnne shifted her career from patent law to whatever this cesspool demands so that she can make a positive contribution toward making the world a little bit better.  Bev Cooper, Janet Phelan,  *****.

The miscreants in this battle however are the nadir of humanity.   Jerome Larkin, ***** all have few redeeming virtues and expose their deficiencies almost on a daily basis.   The avarice and hypocrisy  are beyond contempt.   Larkin has committed the cardinal sins that appropriately bring the legal profession into disrepute.  His frugality with the truth is only exceeded by his disrespect for the Rule of Law and his intellectual dishonesty.   When Larkin totally misrepresented the SCOTUS ruling in the Alvarez case by citing as the law the very proposition that the SCOTUS rejected and characterizing the disclosure of corruption as being akin to yelling fire in a crowded theater he set new boundaries for perfidy, corruption, and disrespect.   The Supreme Court of Illinois in not holding him in direct criminal contempt and removing him from his administrative position clearly failed not only the profession by its legacy (if any). 

The American Bar Association and all the other Bar Associations and lawyer groups that stood moot did a real disservice to its members and the public and the media that was silent prostituted itself.

How I as citizen was surprised by the lack of fidelity exhibited by the key institutions of my profession, my government, and the society I live in demonstrates just how sheltered I've been.  Even articles such as the following are a surprise to me, to wit:


Watchdog Finds Billions in Possible Fraudulent Obamacare Payments

The federal government has failed to properly monitor enrollee eligibility for Obamacare, according to a report by the Government Accountability Office (GAO). As a result, the government has made billions of dollars in Obamacare subsidy payments to individuals that may have been committing fraud.
“When the government wastes money, it is wasting OUR money. It is cutting OUR pay. It is damaging OUR lives,” said Grover Norquist, president of Americans for Tax Reform.  “And the Obama administration is treating us with contempt.”
As the report notes, the system used by the Centers for Medicare and Medicaid Services (CMS) relies on data sent by three government agencies – the IRS, SSA, and DHS – to check eligibility for Obamacare. However, the system used by CMS is unable to verify many inconsistencies in the data.
This inability to properly verify enrollment has meant billions of dollars have been sent out to enrollees without verifying whether the applicants were fraudulent. As the report notes:
“According to GAO analysis of CMS data, about 431,000 applications from the 2014 enrollment period, with about $1.7 billion in associated subsidies for 2014, still had unresolved inconsistencies as of April 2015—several months after close of the coverage year.”
While CMS has information that could shed light on fraud, it has not developed any procedure to utilize it. As the report notes:
“CMS foregoes information that could suggest potential program issues or potential vulnerabilities to fraud, as well as information that might be useful for enhancing program management.”
These latest findings should not be surprising. Time and time again, watchdogs have sounded the alarm over Obamacare exchange verification and controls.
  • An auditor’s report examining Minnesota’s Obamacare exchange found the exchange enrolled more than 100,000 individuals who were ineligible for the program. In all, the audit estimated an error rate of close to 50 percent, and the state overpaid up to $271 million over the five-month period that was analyzed by auditors.
 
  • A December 2015 report by the Health and Human Services Inspector General (HHS OIG) found that CMS relied entirely on data from health insurers to verify whether enrollees had paid their premiums and were eligible. However, this data was completely insufficient - insurers provided payment information on an aggregate rather than enrollee-by-enrollee basis, making verification all but impossible. 
 
  • A October 23, 2015 report by GAO found that Obamacare exchanges (both state and federal) were failing to verify key enrollment information of applicants including Social Security numbers, household income, and citizenship.
 
  • A September 1, 2015 report by the Treasury Inspector General for Tax Administration (TIGTA) found that Obamacare exchanges are failing to provide adequate enrollment information to the IRS for proper payment and verification of tax credits.
 
  • A August 2015 report by HHS OIG found that the federal exchange is failing to verify Social Security numbers, citizenship, and household income of Obamacare applicants. As a result, the exchange is unable to verify whether applicants are properly receiving tax credits.
     
  • A July 16, 2015 audit by GAO found that 11 of 12 fake 'test' applicants received coverage for the entire 2014 coverage period despite many using fraudulent documents, and others providing no documentation at all. From these 11 applicants alone, Healthcare.gov paid $30,000 in tax credits.
 
  • A June 16, 2015 report released by the HHS OIG found that $2.8 billion worth of Obamacare subsidies and payments had been made in 2014 without verification.
 
  • A June 10, 2015 TIGTA report found the IRS failed to properly administer nearly $11 billion in Obamacare tax credits.
 
  • A May 21, 2015 report by TIGTA found that the IRS failed to testObamacare processing and verification IT until a week before the filing season began.
 

I am getting to understand why 'elder cleansing' can occur in America, and it is finally sinking in as to how a 90 year old widow and grandmother can be the gold prospected and have 29 teeth pulled so that a few grains of gold can be extracted from her mouth.    Indeed, even I am starting to understand that there are monsters in our government who see nothing wrong with *****'s action as GAL and *****'s action as presiding Judge in horror inflicted on Alice Gore.    Indeed, I am even understanding how it is that so many senior citizens are being isolated from their prior life, abused, exploited, dehumanized, and after every dollar is extracted can be retroactively aborted without a murmur of protest from the AARP, ACLU, the Republicans, the Democrats, the independents, law enforcement, or the icons of the legal and medical professions.

The legacy and the world we are leaving our children is not the world that our parents and grandparents forged for us!    We turned paradise into horse feathers!     Shame on us!     

If we act now, with the aid of the honest law enforcement officers we might not be too late to salvage for our children and grandchildren a little bit of Americana - BUT FIRST  ******.

Following is a quote of much interest, from pages 246 / 247:
"Nearly twenty years later, former Secretary of State Dean Rusk being interviewed by Peter Arnett on a CBC documentary called, "The Ten Thousand Day War".
Mr Arnett asked, "It has been rumored that the United States provided the North Vietnamese government the names of the targets that would be bombed the following day. Is there any truth to that allegation?"
To everyone's astonishment and absolute disgust, the former Secretary responded, "Yes. We didn't want to harm the North Vietnamese people, so we passed the targets to the Swiss embassy in Washington with instructions to pass them to the NVN government through their embassy in Hanoi ." As we watched in horror, Secretary Rusk went on to say, "All we wanted to do is demonstrate to the North Vietnamese leadership that we could strike targets at will, but we didn't want to kill innocent people. By giving the North Vietnamese advanced warning of the targets to be attacked, we thought they would tell the workers to stay home."
No wonder all the targets were so heavily defended day after day! The NVN obviously moved as many guns as they could overnight to better defend each target they knew was going to be attacked. Clearly, many brave American Air Force and Navy fliers died or spent years in NVN prison camps as a direct result of being intentionally betrayed by Secretary Rusk and Secretary McNamara, and perhaps, President Johnson himself.
I cannot think of a more duplicitous and treacherous act of American government officials. Dean Rusk served as Secretary of State from January 21, 1961, through to January 20, 1969, under President John F. Kennedy and Lyndon B. Johnson.
Mr. Peter Arnett opined that “this would be a treasonous act by anyone else.” A very sad revelation.
Those that flew over North Vietnam always suspected that this was what was happening.
