Philip Seymour Hoffman’s estate sued by neighbors for flood damage in 2011

Victoria Will/VICTORIA WILL/INVISION/APFormer West Village neighbors sued the estate of Philip Seymour Hoffman on Thursday for more than $87,000.Gene Hoffnagel, a retired IBM computer scientist, and his wife, Anna Erdelyi, an art consultant, say in Manhattan Supreme Court papers that the June 2011 flood caused extensive damage to their home.
“They came home from vacation and found the floor was squishy under their feet,” their attorney, Mark Seitelman, said Thursday. He said the water had been leaking into the apartment for several weeks without anyone being aware of it.
Seitelman said Hoffman, who owned other West Village home nearby and used the two bedroom penthouse in 2011 as an office and guest space, wasn’t even aware of the leak because it occurred under his kitchen cabinet.
“The water went straight down. It wasn’t gushing — just a steady leak and it did a lot of structural damage,” Seitelman said.
Seitelman said his clients had insurance to cover the cost of replacing their possessions but their insurance did not cover the cost of repairing walls, floors and fixing other structural damage.
He said Hoffman assured them that his insurance company would cover the excess damage, which comes to $87,329.60, according to court papers.
The lawsuit names as a defendant the estate and Marianne O'Donnell who is Hoffman's executor and mother of his three children.
Hoffman died in February of a drug overdose.
