This travesty is occuring across the country.
President Obama introducued the Elder Justice Act in 2009.
It was enacted on March 23, 2010 with the Affordable Care Act (Health Care Reform) and is the first federal law to take a comprehensive approach to promoting elder justice and addressing elder abuse, neglect and exploitation;
On October 20, 2011, Minnesota Senator Al Franken introduced S-1750 to amend the Older Americans Act of 1965 to establish a Home Care Consumer Bill of Rights, to establish State Home Care Ombudsmen Programs, and for other persons.
· On October 20, 2011, Minnesota Senator Amy Klobuchar introduced S 1744, Guardianship Accountability and Senior Protection Act to provide funding for State courts to assess and improve the handling of proceedings relating to adult guardianship and conservatorship, to authorize the Attorney General to carry out a pilot program for the conduct of background checks on individuals to be appointed as guardians or conservators, and to promote the widespread adoption of information technology to better monitor, report, and audit conservatorships of protect persons.
· Recently, D. C. Councilmember Marion Barry introduced a Bill to expand the City’s Ombudsman advocacy to elderly adults who reside in community residential facilities and assisted living facilities.
A search for best practices and trends shows that many other states are undertaking to address the travesty of elder neglect, abuse and financial exploitation, including guardianshp and conservatorship abuse.
