Prison term sought for ex-prosecutors in cover-up

Prison term sought for ex-prosecutors in cover-up

Prosecutors have demanded 18 months in prison for 2 former senior prosecutors for covering-up falsification of evidence by a subordinate.

Hiromichi Otsubo is the former chief of the special investigation unit of the Osaka District Public Prosecutors, and Motoaki Saga was his deputy.

Their former subordinate is serving a prison term for altering data on a floppy disc he seized as evidence while investigating a postal fraud case.

Both Otsubo and Saga pleaded not guilty, arguing they did not perceive that the data alteration was done intentionally.

At the Osaka District Court on Thursday, a Supreme Public Prosecutor said it is clear from testimony by the subordinate and other colleagues that the 2 tried to pass off the data alteration as an error.

The prosecutor said the defendants hid unprecedented data tampering by a prosecutor to protect themselves and their organization. He called the behavior totally unprofessional and said it should be harshly criticized.

The prosecutor added that the 2 men bear heavy responsibility for severely undermining the public's expectations and trust in the country's prosecutors.

A ruling is expected after the final defense plea as early as March next year.

Editor's note: Regarding the Estate of Alice R. Gore, deceased, a disabled, 99 year old ward of the Probate Court of Cook County, IL, in Judge Kawamoto's courtroom. The Guardian ad litem, Miriam Solo falsely testified in court that Alice's daughter had caused Alice distress while a resident in a Chicago nursing home. Evidence and witnesses disproved Solo's testimony and yet the daughter's visitation was severely limited.  Nothing was done to punish Solo.  It appears that the legal system in Japan is very honorable and does not tolerate corruption.  Lucius Verenus, Schoolmaster,  ProbateSharks.com
