Pauper v. Probate: Desperately Seeking Lady Justice

by Danny Tate

In the First Civil Court of Public Opinion

Pauper Case No. : PD1

v.

Probate Court Filed: November 8, 2011

(The Biggest Business in the World)

Judge "We, the People", presiding

Desperately Seeking Lady Justice"

Today, we will pause to take notice of a positive move in Democracy's direction, or so I pray.

Today, there were three (3) examples of Lady Justice balancing blind.

Today, in tiny print on Page 2 of the Local & Business section of The Tennessean, Brandon Gee, court reporter, wrote about a new web site "launched" by the Tennessee Supreme Court, "aimed at providing basic civil legal resources to those who cannot afford to hire a lawyer". Chief Justice Cornelia Clark said in a news release, "We hope this site can make the legal system more accessible for all Tennesseans, regardless of income level". Tennessee Access To Justice, assisting the Pro Se litigant (Latin, "for oneself" i.e., representing yourself in court without the aid of an attorney) is up and running. This sounds like a very positive move in Democracy's direction, and a very good sign coming down from our Chief Justice, who has been held to the fire @ Impeach Randy Kennedy, but it's not my intention to "throw the baby out with the bath water", but when Tennessee has been ranked #1 Most Corrupt State, something must be wrong within our Judiciary, and it's my hope that Chief Justice Clark will beckon to the call from "We, the people...", for we long for ONE GOOD JUDGE, and I would gladly and humbly bow my head just to face one honorable, "Your Honor". Her statement should have been, "Finally, Democracy has been set free from the chains of tyranny, self-serving our legal system, holding the People involuntarily bound for way too long. Once again, "the people" have full access and control over our Legal System and our Judiciary, the way our Founding Fathers intended it to be when they authored The Declaration of Independence followed in victory over tyranny by The Constitution [Article III]."

It did not read that way, nor closely suggest it, but it was a crack in the thick, steel, vault-door called the Law standing as some portal to Individual Liberties, and a tiny ray of light shone through

If just for Today.

I would like to think I've been stuck on the wrong floor of a bad dream, burning in Hell's Hallway, (the 6th Floor) in Davidson County's Circuit Court.

It ain't like TV, folks, where the judge is this stately hoary-headed old guy in the background, always the voice of reason at the end of each episode of Law and Order. It's more like an insane asylum where the truly insane are the doctors. And it is reality, just not TV.

Also today, Tim McGraw, fellow musician, saw some justice, and for we musicians who have fought the law, but the Law won, it's another ray of hope that Lady Justice is not peeking out and putting her left pinky on the scales, but that music, the greatest power on earth, will be made even more powerful, by conscience.

Tim McGraw recorded one of my songs, "Who Are They", and he grew up in a town that shared the same river, the Ouachita River, and he takes chances. He fought the Law and won, and that is a victory for justice, the freedom of music and conscience.

He also recorded another song I wrote called "Back Door to Heaven", but has never released it.

I hope he does someday.

It deserves its day in the sun.

Back Door to Heaven

If it's down some lost highway, I prob'ly know it well

or at the end of a trail of tears leading out of hell

if it's on the wrong side of the tracks, I'll find it somewhere

If there's a back door to heaven...

I'll see ya there

Today, there was another victory, one of many in my Mt. Everest of legal suits: NEIGHBOURSvTATE #7 FINAL ORDER VOL.NON-SUIT wo PREJUDICE,

And guess what? It was won... Pro Se

Finally, Lady Justice showed up,

blind and balanced,

And I saw a tiny sliver of light.
