AMERICAN BAR ASSOCIATION'S GUIDELINES FOR CLIENTS WITH DIMINISHED CAPACITY

ASSESSMENT

of Older Adults WITH DIMINISHED CAPACITY:

A Handbook for Lawyers

Above is a link to a publication meant to instruct lawyers on how they are to provide services to clients with diminished mental capacity. In our experiences with the wards of Cook County, not only do the attorneys not abide by the American Bar Association's recommendations, but they blatantly violate them. We have many reports of wards being deceived during their probate proceedings by their attorneys and guardians, and countless reports of the wards' estates being depleted by attorneys and guardians' fees due to their inability to comprehend the exploitation taking place. We also have many reports of the wills of clients with diminished capacity being inappropriately "lost", written, or altered during their guardianship proceedings.

Although the ARDC has been unresponsive to complaints submitted by families of wards of the 18th floor of the Daley Center, we still encourage you to report attorneys' wrongdoings related to their exploitation of the elderly disabled wards with diminished capacity in the Cook County Probate Court. Refer to the "ARDC Audit Results" article and to the "How To Report Unethical Attorneys and Judges" article in the index on the right.
